As of August 1st Title IX "protections" expand to include
transgender and gender-confused students. The changes will
impact schools throughout the United States.
That is, except for schools attended by children whose parents are members of
Moms for Liberty...
The Biden administration is on the move. This time it's students and parents in the crosshairs, specifically anyone who doesn't play along with having more than two genders, girls who don't want boys competing with them in sports or invading their private spaces, and parents wishing to be told if their kids question being in the correct body.
The attacks will come via a new protected class under Title IX of the Education Amendments of 1972. These changes come as a direct result of the Supreme Court’s decision in Bostock v. Clayton County, Georgia (2020), in which a 6-3 decision sided with interpreting Title VII of the Civil Rights Act of 1964 as prohibiting employment
discrimination based on an individual’s sexual orientation or gender identity.
Students from James Madison University take part in a rally outside the Education Department in Washington, Nov. 2, 2006. U.S. District Judge Rodney Sippel granted a preliminary injunction Wednesday, July 24, 2024, preventing the Title IX rule from taking effect in Missouri, Arkansas, Iowa, Nebraska, North Dakota and South Dakota, pending the outcome of a lawsuit. As a result of these changes, schools and education programs which receive federal funding will now have to ensure equal treatment and opportunities for all students and employees, regardless of their gender identity or sexual orientation.
But don't lose heart. With the help of the Southeastern Legal Foundation(SLF), four brave moms within the Moms for Liberty organization decided to attach their names to a court case claiming that harm would be done to the children in schools in which these changes would be made.
Current Status
In an open letter posted on Wednesday July 24th from Moms for Liberty founders Tiffany Justice and Tina Deskovich, it is made clear where we currently stand:
Dear Moms for Liberty Member,
Two weeks ago, in a landmark legal ruling, Moms for Liberty secured the biggest preliminary injunction to date stopping the Biden’s rewrite of Title IX regulations from going into effect in what will ultimately be thousands – if not tens of thousands – of schools throughout our country.
Since then, Moms for Liberty and its legal team led by Southeastern Legal Foundation have been working through the legal process to ensure the maximum protections possible for Moms for Liberty members, ultimately obtaining clarification that the preliminary injunction applies to both current and future members and that Moms for Liberty can continuously update the list of schools covered by the injunction as needed.
Today, Moms for Liberty launched a new function through its website, allowing members (current, new, and future) to opt-in to the protections secured by Moms for Liberty’s landmark legal victory. Opting your child’s school in is easy and can be done through editing your profile on our “member portal.” Detailed instructions can be found in our FAQs webpage.
You can find detailed instructions on how to opt-in your child’s school and answers to frequently asked questions here.

So again, the very latest being reported by the national Moms for Liberty team:
“Moms for Liberty and its legal team wants the district court’s July 2024 order to apply to as many schools in the US as possible. To that end, the district court is allowing Moms for Liberty to submit (and update on a regular basis) a list of schools that its members’ children attend so that it can notify the DOE that it cannot
the district court is allowing Moms for Liberty to submit (and update on a regular basis) a list of schools that its members’ children attend
enforce the Title IX rewrite at those schools. The list of schools will NOT identify Moms for Liberty members by name — it only lists the schools, nothing else.”
"Gender ideology does not belong in public schools and we are glad the courts made the correct call to support parental rights. We will always stand up for the rights of parents and the protection of children. All parents must have their voices heard and their right to raise their own children is part of the very fabric of a free America. The federal government has no right to claim our children as their own or to push parents out of the classroom.”
Note that the legal wranglings are not yet over. The Department of Education has filed an appeal in the 10th Circuit Court of Appeals, so stay tuned.
About Our Legal Team
Southeastern Legal Foundation is a national, nonprofit legal organization dedicated to defending liberty and Rebuilding the American Republic®. Since 1976, SLF has advocated for limited government, individual liberties, and the free enterprise system in the courts of law and public opinion. We sue the government when it overreaches and violates your constitutional rights.
Kim Hermann, legal lead, is both an SLF Executive Director and a member of Moms for Liberty.
SLF is not a single-issue organization. We are Freedom’s lawyers and work to combat government overreach, guard individual liberty, protect free speech, and secure property rights. We represent your freedoms in court.
Instructions on how to enter school information in your Moms membership profile. Things to note: This is an opt-in system. Permission to report their school as exempt from Title IX changes is left to each individual member. A member's school affiliation is indicated through their Moms for Liberty membership profile; to add or change this info, follow the instructions in the above link. The school district list contains the name of every district in the state of California. After selecting a district, all schools within that district appear in the schools list. (At this time charter and private schools have yet to be placed on the school lists; if your child is in a charter or public school, please check back...). Multiple schools can be selected within the list.

Downloadable pdf version of Southeastern Legal Foundation's guidebook entitled Your Child's Rights and what to do about them. This legal guidebook is designed to help parents move from defense to offense in their fight against unconstitutional and illegal woke education, and will hopefully be instrumental in saving America's public schools. Watch Kimberly Hermann discuss the publication with John Solomon of Just the News.
The most important battleground in the fight to save our American republic is the public schools. Understandably, parents wonder how to engage the public schools and actually win.

Get Involved...
If you share our concern over what has been taking place in our classrooms, please consider joining with us as we fight for families, for children, for education, for truth, and for common sense.
We continue to ask people whether they understand what is now taking place within our school systems. We continue to provide information and resources to help people, especially parents, gain some idea of what's being taught to kids (and why). And yes, we continue to ask people to get involved and help with the lifting.
We fight against children being taught to hate their country, to judge people based on the color of their skin, and to ignore the basic truths of biology. We fight against the sexualization in school of little ones and the destruction of the innocence of youth. Perhaps most importantly, we fight to ensure that the proper teaching of math, reading and writing remain at the forefront of a child's education.
The idea that it is parents who are responsible for raising, educating, and seeing to the well being of their kids, that is sacrosanct.
Join with us in preserving the attributes and ideals of this great nation.
Feel free to forward this newsletter to friends and family. Actually anyone who acknowledges the fundamental right of parents to raise, educate, and protect their children are invited to join with us. We are gathering a group of joyful warriors, folks who understands why (and for whom) we fight.
Think on this...
ONE OF THE BEST WAYS TO UNDERSTAND SOMETHING IS TO EXAMINE ITS BEGINNING
OR SOURCE. THE BEGINNING OF A THING TENDS TO BE A TIME WHEN THE MOST
FUNDAMENTAL QUESTIONS ABOUT IT ARE DEBATED AND DECIDED.
- Larry P. Arnn, President of Hillsdale College
IT COULD NOT BE LESS FOLLY TO ABOLISH LIBERTY,
WHICH IS ESSENTIAL TO POLITICAL LIFE,
BECAUSE IT NOURISHES FACTION,
THAN IT WOULD BE TO WISH THE ANNIHILATION OF AIR,
WHICH IS ESSENTIAL TO ANIMAL LIFE,
BECAUSE IT IMPARTS TO FIRE ITS DESTRUCTIVE AGENCY.
- James Madison in Federalist 10
THE PROPOSED GOVERNMENT CANNOT BE DEEMED A NATIONAL ONE;
SINCE ITS JURISDICTION EXTENDS TO CERTAIN ENUMERATED OBJECTS ONLY,
AND LEAVES TO THE SEVERAL STATES A RESIDUARY AND INVIOLABLE SOVEREIGNTY
OVER ALL OTHER OBJECTS.
- James Madison in Federalist 39
EVERY MAN WHO LOVES PEACE, EVERY MAN WHO LOVES HIS COUNTRY, EVERY MAN WHO LOVES LIBERTY, OUGHT TO HAVE IT EVER BEFORE HIS EYES,
THAT HE MAY CHERISH IN HIS HEART A DUE ATTACHMENT TO THE UNION OF AMERICA,
AND BE ABLE TO SET A DUE VALUE ON THE MEANS OF PRESERVING IT.
- James Madison in Federalist 41
AN ELECTIVE DESPOTISM WAS NOT THE GOVERNMENT WE FOUGHT FOR;
BUT ONE WHICH SHOULD NOT ONLY BE FOUNDED ON FREE PRINCIPLES,
BUT IN WHICH THE POWERS OF GOVERNMENT SHOULD BE SO DIVIDED AND BALANCED AMONG SEVERAL BODIES OF MAGISTRACY, AS THAT NO ONE COULD TRANSCEND
THEIR LEGAL LIMITS, WITHOUT BEING EFFECTUALLY CHECKED AND RESTRAINED
BY THE OTHERS.
- James Madison in Federalist 48
